This privacy policy (hereinafter "the Policy") is intended to inform users (hereinafter "the User") of the MOSAIK FLOOR website (hereinafter "the Sitethe Site") of the means used tocollect and process the "personal data"(as defined below) of the User, in accordance with the French Data Protection Act no. 78-17 of January 6, 1978 as amended by the Act of June 20, 2018 and supplemented by its implementing decree of 1er August 2018, as well as Regulation no. 2016-679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data.es à l'égard du traitement des doning personal data and the free movement of such donedata (hereinafter referred to as the "Regulation").

The data controller of personal data is MOSAIK CREATIONSASU with capital of €20,000, registered with the Bourg-en-Bresse Trade and Companies Register under number 835 038 043, whose registered office is at 5 rue du Tronfou01700 Saint Maurice de BeynostFrance, represented by itsresident Lionel Hugonnier (hereinafter the'" Publisher").

The Policy may be modified at any time by thePublisherin order to comply with any regulatory, legal, editorial or technical developments. The User must refer to the latest version of the Policy before browsing.

When browsing the Site, we may be required to collectned to collect and process personal Donal data in order to enable the User to access the services offered by the Site. Personal data" means any information that information identifying directly or indirectly a natural person (e.g. name, telephone number, e-mail address, etc.)

As part of its obligations under the Regulations, thePublisher undertakes to limit the collection of Data to that which is strictly necessary (data minimization).

1. Personal data collected  

L'Editor may collect the following Data:

• Account data Utilizeri.e. the data you enter when you create an account to order products (first name, last name, billing and delivery postal addresses, e-mail address, cell phone number, password for customer account login); either directly on the Site, or via the Google, Facebook, Twitter, LinkedIn or Amazon single sign-on offered on the Site.

• Order and transaction datadata you provide when you make online purchases (e-mail addresses, delivery address, telephone number), order history ordersorder history, products purchased, quantities, amounts, any refunds and payment details;

• Data voluntarily communicated by the User for customer service purposes (via e-mail, post or telephone) for requests for information or any other request relating to after-sales service;

• Data entered by the User in the contact form or quote request form: surname, first name, email, telephone number, surface area in m2 and message, as well as the answers provided by theEditor for the management of requests.

Users are advised to provide only the personal data strictly necessary for their request, and in particular not to enter any personal data considered sensitive, such as data that may reveal racial or ethnic origins, data relating to political, philosophical or religious opinions, trade union membership, data relating to health or sex life, data relating to offences, convictions or security measures.  

Data relating to payment methods (credit card number, expiry date, authorization number, security code) are collected directly by our payment service provider STRIPE.

 2. Purposes and legal basis of data collection 

Data collected when using the Site is processed for the following purposes: 

• The creationand management of the Utilizer account,
• Management and delivery of ordered products, 
• Managing customer service requests for products purchased, 

• The management of requests for information, requests for quotes or any other request on the Site, 
• Managing unpaid bills, 
• Carrying out transactions, 
• The fight against computer fraud, 
• Lhe sending of promotional content or commercial prospecting by email or SMS if the User has consented,

• The analysis of visits to the Site and their frequency, audience measurement, the carrying out of studies and statisticss, to improve the Uexperience on the Site
• Management of requests for access, rectification and opposition rights. 

When Data is collected, the User will be informed if certain Data must be mandatory be or if they are optional. Data identified by an asterisk on the information forms are mandatory. Otherwise, access to and use of the services by the User may be restricted.

The processing carried out is based on the following legal grounds: 

• The execution of pre-contractual measures taken at the request of a User who wishes to obtain a quote, information or service on the Site. This pre-contractual execution implies, in particular, knowing the identity, contact details and purpose of the User's request, so that the User can be contacted again.

• Contract execution Processing of personal data for the purpose of fulfilling orders placed by Users. For example, some of your personal data is required to deliver the product, manage the customer account and provide after-sales service;

• Legitimate interest : this concerns processing related to the communication and statistical studies of thePublishers communication and statistical studies, while respecting the balance between the fundamental rights and freedoms of customers and the objective of promoting and improving the services of thePublisher.

• The prior consent of the person concernedfor sending promotional content by email or SMSthe User must have consented to their dispatch, and may object at any time.

• Compliance with a legal obligation: for example, to keep invoices for accounting purposes or to combat Internet fraud.

 3. Recipients of the Data collected 

The Personal Data collected by thePublisher is never passed on to third parties such as commercial partners, unless you give your consent.

OnlyPublisherstaff, its subcontractors, all persons who require such information for the performance of their duties, and, where applicable, public authorities and bodies, are the only recipients of User data, for the purposes set out in this Privacy Policy.

Personal Data may be communicated to third parties acting as subcontractors, bound by a subcontracting agreement to perform services such as order delivery, hosting, storage, communication, payment, database management or IT maintenance on the Site. These subcontractors act only on the instructions of thePublisher and will only have access to Personal Data that is strictly necessary for the performance of their mission. They will be bound by the same security and confidentiality obligations as thePublisher.

For payment by credit card, thePublisher uses STRIPE a remote payment solution whose confidentiality policy and general terms and conditions of sale and use are available at the following addressavailable at the following address https://stripe.com/en-fr/privacy#translation. By using remote payment by credit card, you accept that your personal data, and in particular your bank details, may be stored and used by STRIPE.and used by STRIPE to process payments.

4. Data retention and archiving 

User Data will not be kept longer than is strictly necessary for the purposes set out herein, in accordance with applicable regulations. Furthermore, thePublisher regularly cleans and updates the Data.

In this respect, Data used for prospecting purposes is kept for a maximum of 3 years from the closure of the User's account or the last contact with the prospect concerned.  

In the case of personal data collected and processed for order management and after-sales service, the retention period extends to the statutory limitation date, i.e. 5 years after the end of the contractual relationship. 

Nevertheless, certain Data may be archived beyond the periods stipulated for compliance with accounting and tax obligations, for the purposes of researching, ascertaining and prosecuting criminal offences, with the sole aim of making such data available to the judicial authorities or the administration, where necessary. 

5. Personal data protection 

Personal Data collected by thePublisher remains strictly confidential.

L'publisher undertakes to take all useful precautions and appropriate organizational and technical measures to preserve the security, integrity and confidentiality of the Data and, in particular, to prevent it from being distorted, damaged or accessed by unauthorized third parties. L'publisher has implemented security measures to protect the Personal Data collected, in particular against unauthorized access and use. However, thePublisher cannot guarantee the elimination of all risk of misuse of Data.

L'publisher has also put in place procedures to deal with any suspected breach of data security, and is obliged by law to notify Users, as well as any competent supervisory authority, of any suspected breach of data security in the cases set out by law.

6. User rights 

Users may at any time request access, rectification, deletion, portability and restriction of processing of their Personal Data transmitted to thePublisheror object to such processing.

The User's rights are as follows:

Most of the above rights are subject to limitations and exceptions. If we are unable to comply with a request to exercise your rights, we will inform you of the reason.
